Overview

Surreal CMS (“Service”) is provided by A Beautiful Site, LLC (“Company”). By using any portion of the service, which includes any and all services provided for content management purposes, you are accepting the Terms of Service (“terms”) provided herein. If you do not agree with these terms for any reason, you are asked not to use Surreal CMS. Use of the Service indicates your acceptance of these terms. A Beautiful Site, LLC reserves the right to update or modify these terms at any time without notice. For the most recent, official terms of service, refer back to this page at any time.

Usage

As an account holder, A Beautiful Site, LLC grants you a limited license to access and use Surreal CMS. The Company reserves the right to terminate this license at any time for any reason. This right will generally be practiced only when abuse of the service or nonpayment has been determined.

Billing & Refund Policy

A Beautiful Site, LLC charges and collects for use of Surreal CMS. The payment amount is determined by your subscription level. Payment amounts are calculated from the schedule of fees or ‘as quoted’. The Company reserves the right to modify the schedule of fees and charges at any time, and any such change will come into effect immediately for new subscribers and upon the subscription renewal for existing subscribers.

While the subscription is not delinquent and this agreement remains in force, your subscription will be automatically renewed upon the completion of the subscription period, and where you are responsible for payment, you will be invoiced in accordance with the schedule of fees in force at that time, excepting the case where your service is subject to a quotation or a written pricing agreement signed by a Managing Member of A Beautiful Site, LLC. Any such negotiated pricing terms are confidential and may not be disclosed to a third party.

Subscriptions may be canceled at any time without incurring a cancellation fee. Changes in your subscription may not take effect until your subscription renewal period. Premature cancellation of your subscription does not make you eligible for a refund in whole or part. If you believe your invoice is incorrect for any reason, you must contact A Beautiful Site, LLC within 30 days of the subscription renewal to be eligible to receive an adjustment or credit at the discretion of the Company.

Customers who are unsatisfied with the Service may request a refund no more than 30 days after their most recent renewal period. Upon requesting a refund, your account will be terminated and any refund deemed valid will be issued by the Company. Refunds will be issued no more than one business week after the request is made. By using the Service, you acknowledge and accept that A Beautiful Site, LLC may exercise, at our discretion, service cancellation for delinquent accounts. You are responsible for ensuring the continuance of your account and compliance with this agreement.

Indemnity

You agree to indemnify, defend, and hold A Beautiful Site, LLC harmless from and against any and all claims, liability, losses, costs, and expenses (including attorneys' fees) incurred in connection with any use or alleged use of Surreal CMS.

Privacy Policy

We respect the privacy of our users and we are committed to protecting it. For that reason, Surreal CMS only gathers personal information that is necessary to establish and maintain an account on your behalf.

We reserve the right to modify this Privacy Policy at any time without notice. All changes to our Terms of Service and Privacy Policy will be posted to this page on our website.

How We Obtain Personal Data

We collect and receive personal data that you choose to voluntarily provide to us for your use of the Surreal CMS service. This data is stored on servers in the United States leased from DigitalOcean, Inc. DigitalOcean does not access personal data stored on these servers.

For analytical purposes, we use Google Analytics. Google Analytics is a web analytics service provided by Google, Inc. Information gathered by Google Analytics will be transmitted and stored on servers operated by Google in the United States or any other country in which Google operates. Google will use this information to monitor your use of our service and to compile reports on website activity for us.

For payments, we use Stripe, Inc. Stripe is an established online payment processing service based in the United States. To maintain the highest level of security for our users, we do not collect payment information on our own servers. Certain information, such as your name, email address, and payment information is stored securely on Stripe’s servers in the United States. Stripe will use this information to collect payments for your use of the service.

For sending emails, we use Campaign Monitor. Campaign Monitor is an email marketing and transactional email provider. We store your name and email address on servers managed by Campaign Monitor in the United States for the purpose of contacting you about your account and occasionally to notify you of new products and services offered by our company.

For backup purposes, we use Amazon Web Services, Inc. Amazon Web Services is a provider of various web services. The servers we use are located in the United States, and Amazon Web Services, Inc. does not access personal data stored on these servers.

How We Use Cookies

We use cookies to provide authentication (i.e. to keep you logged in between sessions) and to gather statistical data to analyze how our users use the service, such as which pages are visited and for how long.

You have control over what cookies your browser accepts. You may choose to not accept cookies. However, in doing so, you may not be able to use all the features of the Surreal CMS service.

What Types of Personal Data We Obtain

We may collect the following personal data from you:

  • Name and contact information, including your email address.
  • Account details, including a password for securely accessing the service.
  • Website usage data, such as anonymized usage information which is collected and stored by the Google Analytics service.
  • Payment information, which is collected and stored securely by Stripe.

How Personal Data Will Be Used

We may use the personal data we collect for the following purposes:

  • To create and maintain a Surreal CMS account for you.
  • To provide support to you for your Surreal CMS account.
  • To analyze how the service is used so we can provide a better experience for all users.
  • To contact you about your account and additional product and service offerings.

We only store personal data that's necessary to operate the Surreal CMS service. This information is never transmitted to third parties, except where noted above to analyze traffic or collect payment information.

We do not sell, rent, or trade your personal data.

How Personal Data Will Be Protected

We protect your personal data by maintaining appropriate technical and organizational safeguards designed to protect your personal data against accidental, unlawful, or unauthorized disclosure or use. In the event of a data breach, we will notify users in accordance with applicable law.

How Long Personal Data Will Be Retained

We will retain personal data for as long as necessary to maintain a working Surreal CMS account for you. You can, at any time, delete your account and the personal data we collect to maintain your account. Upon deleting your account, all personal data will be removed from our servers with immediate affect with the following exceptions:

  • We store rolling backups of all essential data to operate the Surreal CMS service. After 30 days, the data is permanently destroyed.
  • Stripe, Inc. stores data necessary to collect payment information. This data is stored on Stripe’s servers and maintained thereafter to serve as a ledger for all financial transactions that occur between Surreal CMS and paying users.

Your Rights

You have the following rights regarding your personal data:

  • The right to obtain details on how your personal data is being processed.
  • The right to, at a reasonable interval, receive a copy of your personal data free of charge.
  • The right to correct or erase your personal data from the Surreal CMS service.

A Note About the General Data Protection Regulation (GDPR)

We are committed to protecting your privacy and personal data. Surreal CMS has always maintained a high level of privacy and security for our users, and we will continue to evolve our policies and procedures as necessary to make sure we comply with privacy protection laws throughout the United States, the European Union, and anywhere else our users are logging in from.

Disclaimer of Warranties & Limitation of Liability

A BEAUTIFUL SITE, LLC DOES NOT WARRANT THAT SURREAL CMS WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES A BEAUTIFUL SITE, LLC MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE. SURREAL CMS IS PROVIDED ON AN “AS-IS, AS-AVAILABLE” BASIS. A BEAUTIFUL SITE, LLC DOES NOT MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

YOU ARE SOLEY REPONSIBLE FOR YOUR USE OF THE SERVICE. UNDER NO CIRCUMSTANCES WILL A BEAUTIFUL SITE, LLC BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME STATES DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF A BEAUTIFUL SITE, LLC SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
